If your phone is faulty its reasonable to request that 02 resolve it.

How long have you had the contract ?

Is it refresh or a standard 24 month one ?

You can cancel at anytime with 30 days notice but if you haven't met your minimum contract term you will have to pay the full term of your contract.

O2 will replace your phone if they either fail to repair it 3 times or it has to go in 3 times for the same repair.
You should not be out of pocket yourself.
If you give us more details we can advise accordingly.
