Hi ive just got a new contract phone from 02 and thay say its faulty but want me to sign a new contract before they will give me a replacement phone is this correct

You don't have to nor should you.
The phone is faulty so o2 have to replace it with a brand new one, not secondhand, not a refurb.
Call cs on 202 and ask them to arrange a doorstep exchange for you.

@Anonymous when you say customer services, did you actually speak to someone who told you that or was it Live Chat?

Yeah this is not right at all, you are within a period where you are entitled to a replacement. You do not have to sign a new contract.
