ust phone them up again (grrrrrr)
they have said there is nothing more we can do over the phone , i did say you did offer me a brand new phone when the claims was 1st lodged he is denied it (i hope its been recorded) also that i wasnt informed of any change in T&C he said well thats not my problem
he said you really are wasting your time calling now as thats out final answer over the phone now and informed me to write in
so will be writing a letter in recorded deliverery informing them everything thats went on from day 1 from 4 weeks ago now
so looks like everyone is getting recon phones with o2 insurance and not new 1 as what you might be thinking,
£10 a month for a recon phone , you must be kidding , going to call o2 up now and cancel the insurance as the claim has already been lodged and lower my tarriff down and also informing them i will be leaving end of contract

Personally I don't think everyone will be getting 16gb refurb 3GS handsets, this has probably been sent to you because you've complained so much.
Too be honest there isn't really any difference between a refurb iphone and a new one. They're refurbished by Apple themselves and are literally as good as new.
However I do understand where you're coming from on wanting a brand new phone - it's what is part of the policy after all.

I think what will happen is that everyone who is waiting for a replacement 3G 8GB will get an 3GS 8GB as soon as they become available.
The reason for this is that a very similar situation happened last year. Apple stopped making 16GB 3G's, there was a wait and lots of people complaining and then they were all given 16GB 3GS's once they were put on sale and the insurance department could get their hands on some.

I'd imagine that ACE insurance haven't agreed to give everyone with a 3G a 3GS because there is a £100 price difference between the two handsets.
Also, the 16GB 3GS will be going out of production very soon too (if it hasn't done already) so giving out the remaining handsets to 3G customers could make the situation worse all round as they'd then be desperate for stock of the iPhone 4 to give to those who had made claims for a 16GB 3GS.

I think therefore if you stop, look at the bigger picture and see it from the point of view that you have a handset which is out of production, however, if you wait you'll be given the newer replacement model and that even though the wait may be a frustrating one - you will end up with an even better phone than you had in the first place.

canwefixit i wasnt given a 3gs phone i was given a 3g 8gig (same as mine)

but as u said its in my contract to recieve a brand new phone , now if i broke my side of the contract o2 would be sending me threatning letters etc

and what makes matters worse is they said which i have a letter from them i would be getting a brand new phone when in stock , its moving the goal posts when they like thats irritating me eg now a recon phone

as for the price difference thats not my problem , they sold me a insurance policy which its there job to accommodate for price increase when a replacement or claim is claimed

It wasn't a 3GS refurb? Well in that case I would definitely be returning the replacement back.

Thanks Rich,

I have just had a call form a very helpful CSA who I spoke to on Thursday, and promised to call today at lunch time. Apparently, the delivery being waited on is due to arrive tomorrow. She said she had been told it had been confirmed, and I haven't heard that before. It would be good if somebody else rang up and got this confirmed, as I'm not sure if it is just one person fobbing me off.

Re: 8gb 3G iphones; apple aren't shipping them to stores anymore, so i can only assume they're not shipping to our insurance department either...
