Happy ending for me.
Spoke to a really helpful person at the CEO complaints and will have the iPhone 3GS 8GB probably by the beginning of next week. Checked the orders section on my account and it's deffo brand new as promised. Was told it was a one off gesture of goodwill as my original phone was a 3G. Fair enough, thanks to the people involved in getting my problem resolved and richie, matt, ronald for the updates. Hope everyone gets the resolution they deserve.

well done diffbear, fingers crossed you will get a new replacement.

yip it certainly is good news that they are seeing sense, it's just a shame that they arent decent enough and lack any moral fibre that they persist with the charade when the game is well and truly up. When you know you have ballsed up you should have the decency to fess up.

Hi All

I am having the same problem as everyone else here. Iphone 3g water damaged. Called o2 insurance, claim went through, phone was recieved (albeit a day later after visting the depot as they did not tell me orignal phone had to be returned). Did not realise it was a refurb until I fully charged the phone and left it on table to come back 20 mins later to see the battery strength drop to around 80% from non use. Spoke to ACE rep and they confirmed it was refurb. After being passed back and forth from ACE and o2 insurance several times. Each time they blamed each other and it was nothing to do with them. Also kept hearing different answers from "it never stated in T+Cs you would get new phone replacement" or "im sorry but T+Cs has changed". I told them their website 'http://www.o2.co.uk/assets2/PRODImages/PDF/O2InsurePremier.pdf' says guranteed new for old replacement. Same old reply "check your T+C" (surely this is false advertising / misleading information).
I would be grateful if anyone has the pdf of the original T+Cs the following link (http://www.o2.co.uk/assets/O2HybridNav/ ... remier.pdf) has been removed.

I originally had the iphone with insurance back in DEC 08.

Im going to pursue this as far as I can any tips would be much appreciated. Also like to thank richierich for the advice to get me started.

Sorry for the long essay lol, good luck to everyone else who is on the same boat and hope all goes well!

Well i have just had my first experience with O2 insure.

Ive been with O2 for too many years now and have had my 8GB 3G for close to 20 months with no issues, i decided due a crack on the case to finally get it replaced after all i have been paying the insurance since i got it.

Any ways i didnt ask stupidly if i was getting a referbed handset or if indeed it would be reconditioned.

My new handset arrived next day, i was upgraded from an 8GB to a 16 as they had no 8's in stock so not all that bad, well that was Friday as of Saturday i had changed my mind. The phone crashed at some point Saturday night so no alarm and missed work...not the end of the world but then Saturday evening i received a call that i was unable to answer (the screen was unresponsive) so i restarted the phone and then preceded to do a full factory restore on the phone and again was still unable to get the phone to react to any touch...

Unable to call insurance as it was closed so i called yesterday and again unable to do anything as the admin department did not work Sundays!
So its Monday and ive spoke to the insurance guys and they confirmed they would be sending out a referbed handset...the guys response was just 'they all undergo the same tests as a new handset' so brilliant ive been all weekend without a working phone and now i get another second hand phone sent to me...i just hope this one goes wrong so i really can start kicking off!

So did the T&C really change then?

Are they allowed to do that without written notice to the contract holder?

Of course they can if you allow them to get away with it!
