iphone 3gs insurance out of stock

has anyone else been having the same problem as myself?
i successfully made a claim 2 weeks ago after losing my white iphone 3gs and was told the phone was out of stock and would be coming back in to stock soon and they would call me within the week.
a week went by without any calls or notifications so i rang them and after being on hold for 30+minutes i was told they were out of stock still and did not know when they were coming in.
i have continued to call them and been told different stories all the time, some people saying there is a shipment arriving from taiwan soon, and some people saying apple are releasing them slowly from america. i dont know who to believe now and they all say the same we dont know when they are going to arrive.
apple has discontinued the iphone 3gs 16gb which is what i had and you can no longer get from them so i dont see why they will be making more handsets and sending them out if they are discontinued.
can anyone give me any advice on what i should do now as it has been over the 14days which in the t&c say they will replace the phone. i have kept to my side of the contract by always paying and they on this case have not.

Ok- the rep at o2 insure said 50-50 chance you will be getting a used phone. Nothing we can do. Take a used phone. Send it back? Then you are without a phone.

this is beyond a joke now. i have not heard back from the complaints department within the 5working days that they said i would be contacted. i think the insurance company is a joke and will be cancelling after i recieve the phone as the only piece of information i had from them was the piece about the prices increasing for making a claim after the 30th september, they are adament that they sent a change of terms and conditions saying the new for old policy was changing to refurbishment models. i said i had not recieved this, but they kept telling me i had. FURIOUS.
also i was told by someone the other day at the insurance company that as i could not get a replacement handset they would keep me informed about the stock and arrange the delivery when they do get them in stock (if they eventually do) by email. but was told the other day by someone else as i hadnt recieved any emails that they cannot do this and whoever said they could was lying.
beyond a joke now
as soon as i get my new handset ill be insuring it with a different company as there are many more online that are cheaper.

hi, i made a claim about3 weeks ago,was told it was out of stock,rang evry other day but just being fobbed off every time,rang o2 customer services which also did not help but kept putting me through to o2 insure who are just a waste of time.like talking toa brick wall, ####.

sorry for jumping in on this thread so late on
i started a thread about the same thing way back in may this year about the same thing and it got over 35 pages long
i and so many other people were in the exact same boat as u lot
o2 did decide to give us all brand new phones after a long 2 months fight with them
to cut a long story short o2 didnt give any of us written notice that the T&C had changed to give us recon phones instead of brand new ones which were asking for as that was part of the policy
but now i believe they have written to you lot and changed the t&c so i think o2 can give you what they want 😞
myself and everyone else on the thread i started cancelled the o2 insurance soon as the new phones arrived as o2 insurance is v expensive for a recon replacement , cheaper ins else where and new for old
good luck all hope u all get sorted i know exactly how u all feel

I lost my iphone 3gs white over the weekend and have been told exactly the same thing. I have no idea how they are getting away with this. I saw a similar thread on here yesterday telling everyone to write to watchdog, which I have just done and I suggest that you do the same. Unless something like watchdog gets involved Im pretty sure we could be waiting ages for these 'refurb' iphones to be sent out. Which in addition, I find to be ridiculous. How are we all paying for this 'premium' insurance to be sent these types of iphone?!!!!
I am so annoyed about this, I am at university and don't have a landline! What am i supposed to do?!!!

Hi guys I'm in the same boat as you been waiting 3 weeks now! Not happy! Just rang o2 insure as had a msg saying the 3g8gb was still out of stock n that's not the one I'm waiting for I'm waiting for the 3gs16gb like most of you. Any way after waiting 59 mins to get thro I was told the message was just a glich went mAd at them n said how many more glich messages are they gona send me!!! I was told apple had a back batch of new phones and that they should be delivered Friday! Were see I dont have much faith. He eventully gave me a freephone number n said to ring back then. So fingers crossed

Hi i tried again today to get a date for delivery,took ages was told that there over 100 people in queue to speak to them.(prob all with iphones) was not given a date for delivery and was in so many words told to bad.I asked about wanting a new phone and they told me it is like for like.I then told them that they had sent me a letter on 31st august stateing changes in terms and condition these were excess going up to £100 and most importantly the replacement phone will now be a refurbished phone.These new terms were to come into affect form 31st september my claim was made long before this so in there letter they are admitting that before 31st september i am intitalled to a new phone.After telling them this they said yes i will be getting a new phone.Just dont know when. I will be emailing watchdog. Lets not let them get away with this.Good luck all

i also got the letter saying about the new changes taking place after the 30th september like the increase in excess and change to a refurbishment model. my claim was over 3 weeks ago now so these do not come in to play with this claim. i said this on the phone to them and they said the underwriters had written to all the customers informing them of a change god knows when as i did not recieve this along with probably everyone on here. the person on the phone kept saying i did, i had to laugh at him in the end as i said do you go through my mail everyday to see what i recieve.
it has also been over the 5days they said they would call me back in after making a complaint as that was part of another policy they read out to me when i made the complaint, it seems they cant keep to any parts of there agreements.
can anyone make up a draft letter to send on to watchdog so i know roughly what to put and say as i will end up just ranting to them aswell lol.
if we all do this they will have to look into it,

I have lost my phone.I am paying £15 a month premium insurance for what, I don't know.They have no phones in stock. I am now being told to hack to my nearest store and get a lended phone....I call my local store and am told yes you can borrow one its a very basic Nokia refurb and will cost you a £25 deposit......no thanks. I want the I phone I faithfully paid an insurance premium for. I just hope we will not be charged for the time spent with out our specifically contracted units ie the iphone 16gb 3gs.
It is absaloutley scandalous how blaz'e they are about it on the phone. Well we have none so tough is there attitude.

I know- they are pretty brutal.
i would encourage everyone having a problem to write an email to complaintreviewservice@o2.com
and outline what the problem is and how you will be leaving unless they put it right. Also let them know what you consider 'putting it right'. I let them know that satisfactory outcomes are:
1.a new 3gs 16gb or
2.a new 3gs 32GB or
3.a new iphone 4 or
4.£499 (cost of an iphone 4) or
5. complete release of my contract with no penalties or further charges (currently the fee for release of our contract is about £1200)
Gave them a deadline of next Friday to respond. I do have absolutely no confidence in o2 to work it out though.
