iphone 3gs insurance out of stock

has anyone else been having the same problem as myself?
i successfully made a claim 2 weeks ago after losing my white iphone 3gs and was told the phone was out of stock and would be coming back in to stock soon and they would call me within the week.
a week went by without any calls or notifications so i rang them and after being on hold for 30+minutes i was told they were out of stock still and did not know when they were coming in.
i have continued to call them and been told different stories all the time, some people saying there is a shipment arriving from taiwan soon, and some people saying apple are releasing them slowly from america. i dont know who to believe now and they all say the same we dont know when they are going to arrive.
apple has discontinued the iphone 3gs 16gb which is what i had and you can no longer get from them so i dont see why they will be making more handsets and sending them out if they are discontinued.
can anyone give me any advice on what i should do now as it has been over the 14days which in the t&c say they will replace the phone. i have kept to my side of the contract by always paying and they on this case have not.

My replacement iPhone 3GS didn't turn up yesterday even thou 02 Insure confirmed that it would be delivered yesterday. So a day off wasted - thanks 02.
Did anyone receive a replacement yesterday that was sent a text on Thursday?
This is getting beyond a joke now.

Hi people. Really happy to see a forum dedicated to this issue as i've been suffering for the past month.
Heres the thing.... I lost my iPhone 3gs and made a claim on the 24th sep. They said "you will receive it when we have stock" Now i thought that was ok considering usually it takes 24 hours so it wont be that long. This is where the trouble starts because i rushed to the o2 shop after work to get a replacement SIM. Get this: the guy puts me on hold to o2 customer services inside the o2 shop for 10 mins so i can transfer my number to that SIM! He then wants £25 deposit if i want a loan phone. I dont have that money regardless of whether i get the money back when i get the replacement. I'm gunna be a dad soon so i dont have expendable income. He said he couldnt waiver the charge either. i went home without a phone.
Now considering my partner is pregnant i need a phone at all times. i told them this and all they did was take money off my next bill in a the way of compensation. tut. how is money off my next bill going to materialise a way of contacting her.
So here we are ... countless dissapoint txt updates reading same thing untill i finally got my phone today.
ITS A REFURB?! I rang o2 and explained my policy was new for old but the agent said that the terms and conditions are subject to change so how can a contract be solid if the meat of it is "subject to change" I expect new for old or better if my handset has been discontinued. There is someone on this forum who has actually got an iPhone 4 through this. I cant say ive seen worse customer service from any company before. Just dreadful. They have lost a customer for life with thier inability to cater for special circumstances and reluctance to provide me with what i am owed.
Does anybody know any confirmed info on what Watchdog are doing?

I had been waiting over 4 weeks for a replacement iPhone 3GS 16gb, after ringing several times and receiving the bulk standard texts saying were sorry blah blah blah. I eventually received a text to say that I would receive my phone by the 27th October my phone arrived on that date but was faulty and did not read my sim card. On phoning O2 I was told it is probably a refurbished model argh! I then contacted O2 insure who confirmed it was indeed a refurbished phone and that I would not get a new one. The have arranged another delivery for tomorrow (29/10/10). I mulled overnight about this and had a look at my insurance docs and found a key facts sheet which clearly states a guaranteed new for old replacement. So my dilemma now is do I accept this phone? I spoke to a supervisor who told me there is nothing I can do, but he did say that I had been mis sold insurance. I’m at a loss as to what to do now. Any help would be greatly appreciated.

Depends when you made a claim as O2 changed the terms from 30 September so they could offer refurbs as well as increase the excess fees. If you claimed before 30th you're entitled to a new replacement so you can either accept the refurb instead or refuse delivery and wait. Another poster has said the issue will be on BBC Watchdog next Thursday so fingers crossed it encourages O2 to resolve this problem.

I was told by a team leader at O2 Insure (a call centre called "the listening company") that they can only send out refurbs although their complaints team can talk to the underwriters on your behalf and offer an alternative. See the iPhone forum where there is a long discussion. I got more info from these forums in the beginning as was in the dark before and couldn't work out why different departments of O2 were telling me it was someone else's responsibility to sort. Now know there are 3 companies involved:
O2, the listening company (aka O2 Insure) and Ace European group.
I've been advised that as we pay insurance to O2 it is up to them to resolve.

great FB group i`ve joined ,
same stries as u guys back in may this year , took me almost 3 months to get my new iphone after refusing aprox 5 or 6 delivery of recon phones
glad im not with o2 insurance anymore
good luck all cant wait to see this on watchdog this thursday
