Well I am having a diffrent problem with my upgrade at the moment. I was on a sim only contract with an option to upgrade for a new phone. So I have done it in an O2 store. The problem started when I found better deal with Phones 4 u and at the o2 store did not wanted to cansel my contract even if I went on the second day of the purchase. Their explanation is that because I made a fast track upgrade I do not have the right to return the phone in 7 days. Its very interesting that when I spoke with customer services first the lady told me that this is illegal and advised me to go to the store to return it. If they refuse me to call to customer services again from the store. But when I have done it the person from customer services wanted to speak to the person from the store and at the end said that I can not return it. When I explained that the previous day I have been advised from their colleuge that everybody should have 7 days cooling off period and what they do is not legal I have been told that their is not such conversation recorded and I have not called customer service. So they just lie! Now I have written a complain at the storeBut I do not think that it will change anything. They do not tread their customer equal. A new customer will have 7 days cooling period, but a loyal customer for more than 2 years will not have the same rights. Funny but true!

I have read another post on here stating that you can't return the phone on a fast-track upgrade. You could try ringing customer service again and asking to speak to a manager.

I've seen this too, but I can't find it in the terms and wonder if it's been removed as I suspect it contravened the distance selling regulations.
