Not pleased with 02 ! My contract.

Hi,

 

I am looking for advice on my current situation with 02.

 

I signed up with 02 for an unlimited +24 month plan and I got an IPhone 5. The only reason I took this contract was because I was told that I can lower my contract after 1 year because I am due to go travelling in 2 months and I have no money to continue paying est. £37 a month. 

 

When I was sold this contract, the sales person made it clear I can lower the contract but hid the fact that 02 can randomly change the tariff and this would basically void me downgrade it. 

 

I find it so disgusting that they have such a clause in place, that year after year after year, when there is hype around new contracts and tariffs that 02 simple change one thing around their tariffs which will ultimately void the downgrading terms. 

 

02 increase the VAT around Feb 2012 but never provided any notice to change in the policy and this just **bleep**ed up my whole plan and contract. Of course you can upgrade at any time.

 

This is **bleep**ing disgusting, unmoral and unethical and I am seeking advice that will assist me in my situation to change or lower my contract.

VAT increases are made by the government. Not O2. They are not responsible for that. You don't really know what you're talking about.

 

If you were sold the contract from Phones4U, your complaint should be with Phones4U, not O2. You signed a contract. You are responsible for it. If you don't pay it, your credit rating will have a marker put on it. You won't get a phone contract from any network, much less anything else. Sorry if this sounds harsh, but that's the reality of it.

All contracts since March 2012 you cannot downgrade, Poor advise from the sales advisor.

 

Only by raising a formal complaint (as long as you can prove what you were told) yo may be able to reduce it. But apart from removing boltons as in another similar thread not a lot you can do.

 

From the T&C that have not changed since march 2012

 

1. General

  1. These are our Tariff Terms for Pay Monthly customers after 30March 2012. They‘ll apply to you if you have joined Pay Monthly, upgraded your phone and signed up for a new minimum term or changed the tariff you’re on (or elements of it) since 30March 2012. If you haven’t done one of these things, the Tariff Terms when you signed up, last upgraded or changed your tariff will still apply until you do or until we contact you to tell you otherwise. If we do contact you to do that, we’ll give you 30 days’ notice before making the change.
  2. Our Pay Monthly tariffs are subject to status, a credit-check, payment by direct debit and the terms of a 30 day, 12, 18 or 24 month minimum term Pay Monthly Mobile Agreement. These Tariff Terms are part of that Pay Monthly Mobile Agreement.
  3. When you sign up for, or upgrade to, a new minimum term contract you will not be able to move to a lower priced tariff (with a lower rate monthly subscription than the tariff you’ve joined on) during your minimum term. If you move to a higher priced tariff, unless we tell you otherwise, the new tariff will start at the start of your next billing cycle. When you move tariff, you may have to accept the Tariff Terms for that tariff at the time you move and they may be different to these ones. Make sure you check our website for the current terms before you change your tariff. If you move tariff you may not be able to change back to your previous tariff.

Hi,

 

 

A person is unable to lower a tariff down on contracts taken out after March 2012.

 

You would need to speak to the person who sold you the contract.

 

Was this put in writing or just verbally.

 

If the latter im afraid your stuck.

 

Options such as selling the iphone to raise some capital to pay off the remaining contract is an avenue of choice.

 

You can lodge your complaint here if you wish

O2 isn't responsible for any increase in VAT charges. Where did you get that one from?

Hi,

 

 

Without anything in writing it would be difficult to prove it was mis sold.

 

You going to have to get past the thought of lowering the contract monthly amount.

 

If selling the phone and paying off the contract is not viable then you will have to stay on what you are on   slight_frown

Any changes will void the contract.
VAT increase made that happen and 02 is responsible for that, they can either occur that or pass it on to customers. It has been happening year after year, VAT decrease or increase.
