Not pleased with 02 ! My contract.

Hi,

 

I am looking for advice on my current situation with 02.

 

I signed up with 02 for an unlimited +24 month plan and I got an IPhone 5. The only reason I took this contract was because I was told that I can lower my contract after 1 year because I am due to go travelling in 2 months and I have no money to continue paying est. £37 a month. 

 

When I was sold this contract, the sales person made it clear I can lower the contract but hid the fact that 02 can randomly change the tariff and this would basically void me downgrade it. 

 

I find it so disgusting that they have such a clause in place, that year after year after year, when there is hype around new contracts and tariffs that 02 simple change one thing around their tariffs which will ultimately void the downgrading terms. 

 

02 increase the VAT around Feb 2012 but never provided any notice to change in the policy and this just **bleep**ed up my whole plan and contract. Of course you can upgrade at any time.

 

This is **bleep**ing disgusting, unmoral and unethical and I am seeking advice that will assist me in my situation to change or lower my contract.

Last comment you must be confusing the rate of inflation with vat.

O2 have apart from 2013 absorbed the rate of inflation and in the past dropped the vat rate or increased it this is a legal issue unlike inflation.

Good luck in the future (o2 informed all customers of the inflation rise in advance)

5. Charges for our Services
5.1 Detailed charging information can be found on our Website and in our Tariff Terms.

5.2 We may increase or decrease our Charges from time to time. If we increase our Charges (apart from for Additional Services), we’ll let you know at least 30 days before the Charges are due to go up and you’ll have the rights explained in paragraphs 5.3 and 5.4. We won’t increase your Monthly Subscription Charges more than once in any 12 month period.

5.3 You can end this Agreement without having to pay the Monthly Subscription Charges up to the end of any Minimum Period you have left, if:
(a) we increase your Monthly Subscription Charges by more than the Retail Price Index (RPI) annual inflation rate at the date we notify you of the applicable price increase; or
(b) we increase any of our Charges (apart from for Additional Services) in such a way that would have increased your total bill for the immediately previous month by more than 10% (if the increase(s) had applied for the whole of that month).

5.4 If you want to end the Agreement because of one of the circumstances in paragraph 5.3 you must give us Notice that you want to within 30 days of when we tell you about the relevant price increase(s). If you don’t give us Notice within 30 days, you accept the new Charges and the Agreement will continue with the new Charges.

5.5 For Additional Services, we reserve the right to increase our Charges at any time and by any amount. We’ll post the new Charges on our Website. If, following an increase in the price(s) for an Additional Service, you do not want to pay the new price then you can cancel that Additional Service (if relevant), or stop using it. For Additional Services with a recurring subscription we’ll let you know at least 30 days before the Charges are due to go up for that Additional Service.5.6 Paragraphs 5.2, 5.3 and

5.4 won’t apply where the increase or change is as a result of a requirement by a government or competent regulatory body. This includes any increase in the rate of VAT, the imposition of a new tax or the extension of an existing tax that has not previously applied.

Phones4U well that says it all..bunch of con artists, always have been. Was in there shop many moons ago intending to purchase a cheap bluetooth hands free that plugs into the lighter socket. There was a sony one that was sold everywhere else at either £12.99 or £9.99, but they had one marked up at £99.99 and also at £9.99. I picked the £9.99 one assuming they just mislabelled the other. I politely pointed out they might want to relabel the other only to be sworn at and told to **bleep** and told to leave the shop. Unreal. Suprised they're still trading.
