taking o2 to court

Hi

Back in August O2 has mis-sold me a Nexus7 tablet contract. Tried to sort it out with their complaints team with no luck, and now seem to be hitting a brick wall with the Ombudsman Services as well. However, still do believe O2 were in the wrong and they did mis-sell, therefore planning of taking them to court should that be my last resort.

As this would be my very first court case of this kind, I'd appreciate any help in terms of directing me the right way. I mean as basic as how do I start and where do I go etc :). I'm guessing that certain things and procedures could depend on where I stay, so just to let you know that I stay in Scotland.

I would suggest speaking to Citizens Advice for correct legal advice.

I take it you have been through the complaints procedure and Ofcom ?

Is difficult to comment without knowing the specifics of why you think you were mis-sold  tbh.

It will cost you more to go to court than the cost of the contract, and there's no guarantee that you'd win. I'd try to seek some free advice from a solicitor before you go any further with it.

I agree with Bambino - Get professional advice for legal matters and unfortunately there is no one regular on here who is qualified to do that.....

Thanks for your reply, folks. As in terms of why I think the contract was mis-sold, to cut the long story short, there was a certain discount promised as a part of the "offer" which was not honoured later on. I would happily go into more detail, but writing from my phone just now, so I'd leave it for later. Btw, is it possible to post screenshots/pics in here?

As in terms of complaining, I've already gone through the whole route and my complaint is with the Ombudsman now, however, judging by their reply, there's hardly going to be any sort of satusfactory resolution from their side. (Toby, thanks for ur good intentions, do you think it still can be resolved with O2 at this stage though?)

So, the court seems to be the only option, and tbh I am prepared to go down that route as I'm fully convinced that O2 is in the wrong here.

Again, any practical advise, preferrably based on own experience, on how these things are getting done in Scotland, would be much appreciated.
