taking o2 to court

Hi

Back in August O2 has mis-sold me a Nexus7 tablet contract. Tried to sort it out with their complaints team with no luck, and now seem to be hitting a brick wall with the Ombudsman Services as well. However, still do believe O2 were in the wrong and they did mis-sell, therefore planning of taking them to court should that be my last resort.

As this would be my very first court case of this kind, I'd appreciate any help in terms of directing me the right way. I mean as basic as how do I start and where do I go etc :). I'm guessing that certain things and procedures could depend on where I stay, so just to let you know that I stay in Scotland.

Yes, I do agree with what you are saying, that's why I'm referring to the website screenshots and the phone conversation with the O2 customer service rep.

 

If one, and I mean the ombudsman investigating officer here, would take into account that the info on the O2 website clearly implies that the discounted tariff should be £10/5GB (proof i.e. screenshots provided) and that there is a phone conversation where O2 confirms the same (calls are recorded, right?) then he/she would use it when investigating the case, no? An unbiased investigation would (should?) mean that the ombudsman would challenge O2 about it. It does not look like this has been done in my case.

Im in the exact same boat as you now with a default on my credit file and all chances of a mortgage destroyed. My case was with the ombudsman and ive hot a brick wall .. Did you get any help with this as i want to start legal proceedings - Thanks in advance

So far, I'm still waiting for the Ombudsman's decision. If I do not get what I consider a fair resolution out of it, I'm just going to see my lawyer about it in order to find out what can be done. Some might say that it's not guaranteed win, and that it's simply not worth neither money nor hassle, but for me it's a matter of principle. I would never ever treat any of my customers the way I got treated by O2 in this instance.

 

Would you mind sharing the details of your case at all? Has it got something to do with a promise that O2 made but refused to honour later on, like they did in my instance?
