Just so that you are aware, you aren't talking to customer service here.
Anyway in response to your question, unless you have mobile data turned off, your phone can and will use data at anytime.
Smartphones are constantly connected to a data source.
If you would like to call customer service on 202 they will investigate the issue for you.
