Can my mam upgrade her phone and give it to me but she still wants the old phone and contract she has. If so could I use the upgraded phone on pay as you view ?

Yes she can upgrade to a new phone which you can use on PAYG as long as you are on o2 also.
If not she will need to get the phone unlocked first.
