Ok so here is a question. In the o2 shop, you can purchase a sim only contract with o2. 

 

On the picture attached you will see there is a reference to 4g coverage and it clearly states:

 

Depending on your device and location, you may be able to get 4g but don't worry if you can't as you will be able to see 3g.

 

That is a very bold statement as there are huge areas of the country, especially in the south west where there is no 3g at all. 

 

This could be taken as false advertising and as such could represent a potential for breach of contract on the part of o2.

Re "use 3g" that is clear cut. You can't use what you can't get.

As for "depending on location" the key here is what it states after as it clearly says you MAY be able to get 4g but if not you CAN USE 3g. That is clearly false if there is no 3g available.

@Toby this needs changing before I toddle off to the Advertising Standards Authority.

Hence the "depending on location" bit as 3g may be available, if no 4g, depending on location......

I seem to remember you having to explain this to me Rich... when I told you I had a text and 'our area was getting 4G'. I got quite excited .....for at least 10 minutes...LOL

Yep it basically states if your location doesn't provide 4g then you WILL be able to use 3g and of course that isn't true

It's all down to how you translate the words into what is reality or expectation.
We all know there is no consistency of signal in all areas but I guess some could interpret the words differently.

Yes it's very much down to how one reads and interprets it. I'm surprised they use that actual wording to be honest.

The wording appears as:
Don't worry if you are in an area that is not 4g as you can get 3g.
But could also mean
Depending on your device or location you may get 4g but if not you can still use 3g if available in your area.

Imo it's misleading to the general population but asses are covered.
