Unused Contract/Data

I bought a contact phone as a present, but then had the device returned, so the phone (broken) and therefore the contact are never used. Although I understand the device must be paid, do I still have to pay for data that will never be used?

If you bought it from o2 directly on a refresh contract, you only have to pay the device off and the airtime can be cancelled for free.
If you bought from another trader though, you must pay the full contract amount.
