Poor Quality Refurbished Screen

I recently joined O2 and purchased a "like new" Samsung S23 Ultra.

 

Got the phone and it looked great although it looks like the screen has been replaced at some stage and something doesn't seem right.

 

Firstly the bezel at the bottom of the screen is uneven. There is more of a gap on one side than the other.

 

Secondly there is no way that the screen is Gorilla glass victus 2. It's literally scratching from just being in my pocket with nothing else (and no sand/grit). As a result I've got lots of micro scratches and I've not even had it a week.  I see that I can exchange it as I bought very recently but I'm concerned that I would get penalised for returning it as is.

 

Could anyone offer any advice please?
