If I take out a new 36 month contract, is the contract for just the phone, the plan or both

It's for both. Once the phone part of the contract is paid up, you then only pay for the airtime.

On refresh the contracts length is set by the device plan, so in your case it's 36 months. The airtime part of a refresh contract is a rolling montly plan - this is how you can update early on refresh, if you pay your device plan off the contract effectively ends and just becomes a rolling monthly airtime contract. So another way to look at it is your contract at most will be 36 months - but could end at anytime if you pay off the device.
