Contract in ex’s name

Hello looking for advice if possible? 
id like to get a new phone, new contract & new number. 
my current phone is in my ex’s name & we split up & I’ve moved out. 
I pay the monthly fee from my bank account however I have no access to my o2 account only he does so he can see which numbers I message & text etc. 

I want to take out a new contract and simply hand this phone back to him however there is still £409 left to pay on that contract. 
My question is, is that £409 for me to pay or him since it’s in his name? Can I cancel my direct debit & if I do can I be chased to pay the £409? 

I just want rid of him now & this is the only thing left he has control over. Thank you

If the contract is in their name and they were the one to pass the credit check then they are the one liable for any debt not you, whoever pays the bill. If you return the phone to them then it is up to them to keep up the payments 

This is not O2 and we are all customers here similar to yourself and cannot answer account type queries.

Cancel the direct debit

Just bear in mind that you will need to pass the credit check for the new phone in your name
