Wouldn't the construction company be liable for any compensation?
Don't they have insurance for this kind of thing?
I remember when I started my IS (IT & Server) installation and support company, I had problems when trying to get liability insurance. The insurers were a little apprehensive about the cover they would give me because I offered onsite server installation & support, and what if I knocked a power cable, shutdown a companies infrastructure and cost them loads in loss of earning...
As I said ealier, they claim off the idiots responsible, you claim off O2.
So I'm guessing O2 will be suing the company for the costs of the engineers working atm, and for their loss of earnings because we aren't making loads of calls, surfing (mob-web) and texts at 1am in the morning. As well as any successful cases from their clients, like Devans
I feel sorry for those customers who have not got the guts to stand up for their rights. Your loss.
I have the guts but this is just pety.. for a few hours from 9 pm onwards... I mean if you really want a lawsuit why not take on apple for their lack of privacy? The amount of accounts being hacked currently to which they do nothing about! Also fully display all your contact details including card numbers for whoever has hacked your account... THAT IS a proper case for a lawsuit not having phone calls from family, gf, friends for a night that I believe is petty.

The chances of you winning are fairly high, as with any or most Commercial organisation they will mostly pay or agree to certain wishes of the client / customer, in so to avoid the bad and negative publicity. It has been done many a time. They dont have to admit liability, but in either paying or agreeing in or to somerhing, they pretty much have admitted something wasnt right.

I am not afraid of the big boys, I have taken on the UK's biggest company and a Government department before, and won.
Once I have won, and O2 are told to pay compensation, if they do not pay up, I'll send in the bailiffs, and if compensation is over £750, I'll use Insolvency legislation and issue a Statutory Demand against the company.
Oh, this gets better by the minute !![]()

I always laugh at people threatening legal action over little niggles too, people shouldn't be total reliant on just one provider. Smart people have contingencies for when things don't go the way they want. I say that consumers lack of planning contingencies have put them in this predicament, not the unforeseeable.

I wouldnt be lauging if I was an O2 Advisor right now, they might have to get rid of a few to pay some compo to a fair few people.
It is nothing I am worried about at all, it wouldn't be myself going if it came to that, which is doubtful in itself.
Many people said that I would not win when I took the Dept for Transport to court, but I won, the same when I sued Tesco.

Even so, you can throw all these bits of legislation at them, but the one thing that may be your downfall is that you accepted and agreed to the terms that in situations like this, you recognise that O2 are not liable. It all falls down to what the judge decides on.

Oh I do, but cannot be actioned until 8am when we speak to our 0800 service provider to get the 0800 number redirected.
