Fraud with account opened in my name!

So, someone has opened a new account in my name and returned the device-apparently this is not fraud!
I had a letter a couple of months back about a missed payment of £14, called O2 and they advised if it isn’t my account and they can’t find anything on their system and to throw it away.
Found missed payments on my credit file and called numerous times to sort it, couldn’t answer the security questions so they advised me to go in to a store and show my ID which I did.
Called them again today and they have now said it’s not fraud as the device was returned?!
I have never taken out another contract or received a device!!!

Sounds like you're gonna need proper legal advice @Vix1013 

Start with citizens advice bureau.
