If you took your contract through a 3rd party, like Carphone Warehouse or MobilePhonesDirect, then you are on a standard contract - so a fixed minimum amount for a minimum number of months (normally 24).
Once that minimum term ends you can either upgrade or do nothing, but doing nothing means you are paying more than you need to @1bb.
You need to upgrade with someone to take out a new deal - with or without a new device (up to you) at a price you are happy with.
