o2 iphone insurance

hi there 1st post here so lets go

went off on holiday over a month ago came back reported my iphone volume switch has came out (iphone 3g 8gig) over 12 months old
got the insurace £10 a month

o2 insurace accepeted the claim , but they dont have any phones in stock

this has now been going on for 2 weeks , and got a snoty letter back off them this morning saying tough we dont know when we are gettiing them in stock ya just have to wait (words to that effect)

not happy in the least

i asked for the new 3gs , they said no straight away

i pay all my bills ontime (DD) so thay cant throw that back in my face

any help guys nd no i`m not bothering with the ombudsman (waste of time)

Thank you for your further email and the insurance terms and conditions information you have provided me, dated 2009. I'm sorry that I've previously provided information regarding our latest insurance terms and conditions, dated March 2010.

I have queried this with our insurance team and looked into the changes of the terms and conditions of the insurance policy.

Unfortunately, I'm unable to amend your current insurance claim to be processed from the terms and conditions dated January 2009. Our insurance team can only process claims using the latest policy conditions.

As the insurance policy states, contact will be made to you by letter, giving no less than 30 days notice, to any changes made to the terms and conditions.

The insurance service is administered by ACE European Ltd and they are responsible for administering your insurance contract. As you have stated, you did not receive a letter notifying you of the changes to your policy, so you will need to contact ACE direct to query this further. Their address is as follows and they are responsible for sending out the amendments to the terms and conditions:

No one did and from that letter O2 are saying it's not their fault

if thats there final response then next step is to inform the ombudsman , thats what the ombudsman is waiting for a final response , then they can flex there muscle

I signed up for insurance with and I'm paying O2, not ACE... i'm just getting passed about and lied to by Ace... Will leave it up to the ombudsman
