Lost phone and upgrade

I lost my iPhone 4and the insurance company still won't pay out. I am 11 months into a 24 month contract . Can I upgrade or change my contract to get a replacement phone. If that's not possible can I stop my contract as I don't want to pay for a phone which I'm of using?

You would have to pay for the remaining months to do that.

 

Wouldn't it be cheaper to buy another phone to use with your existing contract?

In all honesty you can do neither. To upgrade you would have to pay off the remainder of your contract and do the same if you wish to terminate the contract.

 

You need to chase the insurance company and make sure you abided by the stipulations inserted into the T&Cs.

 

Failing a pay out from the insurance you would need to purchase a new phone at your own cost and use your contract sim in it.

What an awful situation to be in.

I hope you manage to either get an insurance replacement or a good deal on another handset.

Yes I did get a new sim from O2 but wasn't sure whether I could use this with another phone other than an iPhone.
They are expensive and I'm waiting to see whether the insurance company will pay me anything even if they don't replace the phone. But they are taking a long time to decide

They say that they would need to replace the iPhone 4 which isn't made any more with an iPhone 5 which is above the limit for their payouts for a phone
