O2 Open & ‘Like New‘ Phones

Hi. I’m trying to work our if O2 Open airtime discounts can be applied if I upgrade to a ‘like new’ phone. Terms mentions that all brand new phones are eligible. It doesn’t explicitly exclude ‘like new’ phones so I’m not clear. Can anyone help? Thanks.
