How is this possible I have been billed on 13th yet device's only come last night and on phone already after around 2hr exceeded 80% data how is it possible only downloaded around 6short mp3s etc way before allowance

You always get billed early for the first bill which has an extra couple of days on it to align your billing cycle.

Your allowances are also only pro rata for a couple of days because of this and you will get full allowances from the first day of your full billing cycle.
You can track days and usage in your MyO2 http://www.o2.co.uk/myo2

If you have been billed before the phone arrived you could also call and get a refund @Anonymous.

Yes this happens frequently  especially when a phone is out of stock. It doesn't stop o2 billing you....
