I had a phone call today off a secondary company saying I'm eligible to upgrade as I only have 12 months left

Ignore the cold call.

You can't upgrade 12 months early with O2. 
There are some dodgy resellers who will tie you into never ending business contracts with no way out of them. 
Call 202 and say upgrade to confirm your options with O2 directly.
