Hi quick question if I buy an upgrade on my old phone am I still able to assign the new upgrade to the family discount or does it need to be a new phone and contract.

You can apply for the discount on an upgrade to your tariff. 

There is no requirement for you to buy a new phone provided that you text the code from your lead device.

Sorry but no you can't ....

11. For the avoidance of doubt if you upgrade a Family Plan connection you will need to reapply for the Family Plan airtime discount.
