can someone clarify if a new credit check is carried out if I switch up to new device, some advisers are saying yes others are saying there will not be a credit check,
do not want to go instore and start process and end up being declined due to poor credit, my O2 BILL is paid by DD in full on time every month

You'll be fine. There is a credit check but only a soft one.
As long as your bills are all paid with O2 you will be accepted.

thanks, just i know a normal credit check will be declined and there has been so much confusion about the process from several o2 CS agents some saying it wont be a problem, then another saying if I go in store it will be full credit check and if it fails i will not get the original device back, so did not want to be left with no device
