My current phone is immaculate apart from 2 small scratches on the phone. I pre orderd a new phone and the instore team accepted my device but said it is borderline whether it will be accepted once I return it.
I am insured with O2 so I guess my question is do I submit a claim or wait to see if it is refused? Will I then be given the opportunity just to pay my insurance excess and they can keep the phone?

I doubt insurance will pay for small cosmetic scratches if the phone is working OK.
There will be an excess anyway

It depends on how small those scratches are, and if it fails they wont return the phone or ask you to pay any excess they will just bill you for remainder of the plan on the phone sent back.
This is why I stopped preordering phones when they say you need to post it in, it's a world of hurt waiting to happen.
If you are doubtful, take it an authorised repair shop and ask them if they would fix the scratches.

The shop just said it was borderline. Whilst they are a few mm in size you can feel them.

If you can feel them then it needs repairing.
As I can almost see Ingram refusing it instantly...
