I got new phone one week ago.today it fell and screen shattered.screen smashed.i have/pay full insurance monthly.when contacted 02 was told I'd be getting a refurbished phone.as part of my contract I'm am paying full price for a brand new phone.does 02 have the right to only give me a refurbished phone or am I within my rights to ask for a new phone??thanks.any info appreciated

Your insurance T&C's determine what you are entitled too so check them and see what it says.
In all honesty, most ins policies will only replace with a refurbished phone.
