I was told by an advisor that If I pay of my device plan on o2 refresh , I can brake my 3 year air

So like us all in cost of living my contract is costing £60 more than can afford and want to go back to gifgaff.

A was just checking if this is correct the advisor said that if I pay  of my device plan on o2 refresh they would let me end my contract early on the air time plan is this the case.

I only have £500 left on my device which is more managable than  3years x 12  x 60 quid? =2160?

Yes that's correct. Pay your device off and get your pac and you are free to move.

But does it cancel my air time contract

Yes it  ends the airtime contract

Don't cancel your direct debit until you receive your final bill

No it will only be for the airtime you have used, you may even be in credit

I must admit that is a hell of allot better than it used to be people got scared of 3 years worth of payments did a new law come into affect making the illegal?

Airtime contracts can be no more than 24 months.

OFCOM brought in that ruling some time back.

Yes. I do this all the time and just did it with my iPhone 13 Pro Max. I was offered a deal with about 300 off tye device cost so I took it. Three months later paid the devise plan. 

At the same time I spoke with the agent about a new deal and was able to get a simo deal for a fraction of the cost
