Hi

I am upgrading and getting a new phone, but as I don't really need the phone I will give it to my nephew. He has his own sim. Can he simply use his own sim in the new phone, while I continue to use my old sim in my current phone?

Yes you can.

The new contract tariff will be applied to your sim so you will get those allowances that come with the upgrade.
