Contract renewal issues

So, I am on an 18 month contract for a HTC Sensation. It ends on 6th April 2013. All the time i have had the phone, MyO2 has stated that my upgrade date is 3 months earlier on 7th January 2013.

 

Last month i queried part of my bill, and this was kindly resolved during the web chat. I discussed a few queries i had as i wanted to cancel my contract and renew there and then (as my phone was playing up) and pay off the contract (i wanted to know if i had to pay up to april or january to cancel to be specific). The operator then confirmed that i could upgrade on 7th january.

 

Fast forward to today, and i contact web chat, asking if i can order my upgrade now or later this week, so that when the upgrade takes place, my new shiny phone will be in my hand on the new contract start date. I am then told that i can upgrade on 7th March 2013... What?!

 

This is the conversation:

 

"Rakesh S: I can see that you can upgrade the contract on 7th March 2013

Foshiznik: According to myO2, it states "You get 3 months early upgrade so you'll be able to upgrade on 7th January 2013"

Rakesh S: That is incorrect, Please ignore that

Rakesh S: You are on 18 months contract and you can only
upgrade before one month from the contract end date.
Foshiznik: is there any reason for this to change?
Foshiznik: it was always 3 months before, and
including december 2012
Rakesh S: The status showing on your account is
incorrect and not updated, please ignore that.
Foshiznik: Thank you for making me aware of
this change. Can i ask why this has changed?

Rakesh S: Earlier there was different tier and according
to which the upgrade date was setup but now there is tire and all the
customer are in the same category.

Rakesh S: All the customer can upgrade only before one
month from the contract end date.

Foshiznik: does that only apply to 18 month
contracts?
Rakesh S: It is for both 24 months and 18 months
contract.
Foshiznik: so to confirm, all 24 month and 18 month

contracts only have a 1 month before contract end date upgrade
Rakesh S: That's right.
Foshiznik: seems strange that some of the new

contracts i was looking at potentially take on, on upgrade date of the
7th january (mostly iphone contracts admittedly) had 3 month upgrade. Could i please ask when these new T&Cs
came into action?
Rakesh S: It was from 1st November 2011.

Foshiznik: can i ask why the current tariffs within
your shop have 3 month and 6 month upgrade dates then, if this has been
in play long before these phones were even released?
Rakesh S: Please ignore that there is no 3 months and 6
months upgrade..."

 

Surely all this is incorrect information he is giving me?! I have been looking at nexus, HTC 8X, Samsung S3, Activ S, iPhone 5, etc. and all have optional tariffs that have 3 and 6 month early upgrade deals on them.

 

Anyone know the answer? Can O2 change my early upgrade date without telling me? According to Rakesh, i should have recieved a text in Nov 2011 (i don't remember it).

 

He went on to tell me that myo2 hadn't updated my upgrade date for the 14 months between November 2011 and now too... Anyone have the same issue?

You can't do anything until the 7th even if you get through to CS, so just hang on until then and you will be able to do it online or in store.

Tried calling and it hangs up as my upgrade date isn't until the 7th. Should I go via general cs instead?
