Changing tariff through car phone warehouse

I am on a sim only pay monthly contract with o2. I want to stay with o2 but upgrade my phone and o2 contract through car phone warehouse as they are offering a better deal than going direct to o2. Can I do this without incurring a penalty as my o2 tariff renews 11/12/18 but o2 are saying I can upgrade?

If you have had your simo for 3 months and are up to date with your bills, you can upgrade anywhere.

Refresh is only available directly from o2.
