I cancelled a new contract with in the 30 day period and sent my handset back and I received my upfront payment back but my first bill was due and I paid a device payment and also the tariff payment, should I got these refunded and the phone was returned under the change of mind period

If you used the phone at all, then yes you would have been charged.

You only get a total refund if the phone was returned unused.

You shouldn't pay the device plan but will be charged for any usage of the airtime.

Phone had been taken out of the box but the SIM card didn’t get put in or used
