Can I upgrade if I pay off my device plan?

As mentioned above can I pay off the contract and upgrade early?

 

Also as I have the anytime switch up if I upgrade will it move me over to the 90 day switch up T&C?

You can pay off the Device Plan fully and then end your Airtime Plan, @Soks99 Guide: Cancelling Your Contract 

The Switch-Up rules changed some time back, O2 Plus Plans feature in the mix now - check here to be sure: Guide: Introducing O2 Switch Up. Swap phones whenever you want!

Should be possible. My sister did it with vodafone.

I suspect that O2 and Vodaphone have Terms and Conditions with both similarities and with differences ; just because your sister did it with Vodaphone doesn't necessarily mean that she would be able to do it on O2.
