I tryed to get a iPhone on pay as you go and I was refused but they still tuck my up front payment

Not sure why you'd be refused to buy a PAYG phone but if the order didn't complete, O2 won't have taken any money.
Your bank will hold it in a shadow account and return it to you in a few days time, depending on their policy for this.
If you wish to confirm this with O2 you You need to contact payment management.
