Hi

Unfortunately missing a payment puts a default on your account....You may have paid it off and it is up to date now.....but O2 will have probably made the decision to hold fire on allowing you to upgrade just yet..

I would try again in a few days or if the refresh tariff is not a deal breaker then try carphone warehouse.

Edit.

Disposable income allowing you could drop onto a sim only tariff which may be lower than your paying now with possibly better tariffs.

Sell your current phone if you want another and use the accrued funds to buy one outright from O2 as a payg handset or from places such as CEX on the high street.

Just an idea.

I'm pretty sure there is a 6 month continual payment rule before upgrades are allowed and it sounds like they have chosen to invoke this in your case.
You might get it overturned by trying again and speaking to a different advisor or by writing to complaints and asking for a review http://www.o2.co.uk/how-to-complain
I have no affiliation whatsoever with O2 or any subsidiary companies. Comments posted are entirely of my own opinion. This is not Customer Service so we are unable to help with account specific issues.

Ripping off is a bit over the top when all they are doing is invoking their policy, after all you are the one that defaulted. Was there a direct debit in place?
