one claim only!!

Hi all, A month ago I lost my mobile down the beach so made a claim. The insurance company denied me because it was in a public place. I has annoyed and was going to dispute it but I got a call from the police saying some one had handed it in, I have a police statement to prove it. Very nice guy. So I ring up O2 and got it reconnected and asked if I'm still insured and they say yes.
Any way, a month later I was packing to move and lost my phone again. I've had the phone for 2 years and have been paying insurance the whole time. I ring the insurance company and report it and they say I cannot make more than one claim on the same handset.
I asked why I wasn't informed this when I lost the phone the first time and why have they continued taking money from me. I dispute it and they had a meeting or something and said they would get back to me. They didn't. 3 weeks later I wait in line on the phone for an hour for them to tell me no again. In these three weeks I noticed they are still taking money from me!!!
Is there anything I can do now? Thanks for any help.

If this were the case then why didn't they cancel your policy after the first claim?
No one in their right mind would continue paying for an invalid policy, I believe you have been wrongly advised.
Phone O2 Insure back and tell them you want them to send you a final response letter setting out exactly why your claim has been declined as you intend to refer the matter to the Financial Ombudsman Service.

They seem to be making up the rules as they go along.

Thanks for the advice guys. No I haven't received any paperwork at all.
So I'll rung and ask for the T&Cs and my final response letter.
I lost my phone down the beach when getting into my wetsuit. They said I left it in a public place.? Then got a message on a forum I'm a member of saying an iPhone was found down the beach and handed in to the police. Couldn't get it for 2 weeks due to work. Then 2 weeks later I was packing and lost it again. I think it was partly because I'd become use to not having a phone.

Exactly, stuff happens which is why you insured it in the first place!

I think that it's left unattended in a public place which they might mean.
If you lost it while you were out and about such as it fell out of your pocket then you would be covered.
They might think it's a bit dodgy that you've had your claim denied so now you're wanting to claim just a few weeks later, so long as you've been using your sim in it though then I can't see why they'd have a problem. It's not something I've come across before though so I'm not saying I'm correct.
