02 have misled my partner, he went to upgrade to a iphone 5c 16GB to be told they were no longer available and not made. He was palmed off with a iphone 5c 8GB. Fast forward 2 weeks, he discoveres the iphone 5c 16GB on the 02 website , strange seeing as these were not made anymore... So we rang customer services only to br pased from pillar to post and told after 2hours they cant and wont do anything. So i email the CEO's office to be greeted with a ignorant woman called Sharon Kelly, she spoke down to us as though were scum, explained everything and they offered the phone he wants but for an additional £120, which we were told could be paid £5 on top of his monthly bill, she ofcorse says no this has to be £120 upfront or 2 installments of £60.this is not good enough. All the customer services reps keep giving us wrong information, they made the blunder, they told us he could not get the phone he wanted due to it not being made anymore yet they now want us to pay for it, ?? Why should we? We are not happy with our service. We feel we have been misold a contract. Any advice?

Hi

Did you upgrade via a call to customer services ? If so the calls are recorded.

If at a store then revisit the store and speak to the member of staff and manager of the store.

You need some form of proof of the mis selling.

You do only have 14 days to swap handset once on the refresh tariff.

Their is as you know a complaint procedure which starts from http://www.o2.co.uk/how-to-complain

I understand you've gone from information from the source but it is also always best practice to do a little home work ones self before agreeing to the deal and hardware.

As others have suggested, raise a formal complaint through the link at the bottom of the page to begin with.

 

Failing this, do what i done and pick up a Small Claims Court Form (N1 i think), take a picture of it and email/attach it to all emails to O2 stating you are willing to proceed down this route unless immediate action is taken.

 

Hopefully this will get the required outcome like it did with me!!
