Hello,
I'm from Germany and i actually never been in UK. (Hope my english is good enough)
I recently bought a mobilephone (HTC HD2) from a person in eBay in Germany.
The phone was bought in O2 UK, I'm a customer of O2 Germany but my Provider advised me to contact o2 UK.
The Phone worked great but since yesterday the touchpanel stucks sometimes.
I tried to flash the newest ROM from O2 UK and it worked but it didn't help to solve the problem. It's still there.
The phone is in a very good condition, it looks like a new one.
The Void-Seals are not broken.

I don't know the exact answer to your question, but what you have said makes sense. If O2 UK originally sold the phone then O2 Germany might see the warranty resting with O2 UK. Did you receive any paperwork from the seller so that you can prove when it was supplied by O2 etc?
Do you know how old the phone is? If it is still covered by the manufacturer's warranty then it may be worth speaking to HTC as they are usually quite helpful.

The phone is 3 Weeks old. So it should be still covered by the manufactures warranty but HTC in germany advised just as O2 germany did, to contact O2 UK or HTC UK.
But contacting O2 UK is harder then it should be. You need an phonenumber from O2 UK in order to contact O2 by E-Mail over the O2-UK-Web page.
I didn't get any letter (Bill etc) from the seller.
I just got the phone with the original package and the accessoires which belong to the phone (UK charger, headset, leather case..)
Do you know how the procedure of reparing phones in O2 UK is?
For example in O2 germany you just call O2 support and they advise you to send the phone to O2. After a few days and after checking the phones condition (broken Void-Seal etc.) they just send you a new or a refurbished phone back.
Another alternative would be to call O2 UK's service but i think this would be very expensive slight_smile
I also tried the O2 UK chat actually I TRIED without success. As far as i've red in the internet you just have to wait a few minutes with the opened O2 UK page until the Chat pops up.
It didn't work.
Now I'm trying the support-Forum here and I hope an O2-Supporter will read this.

unfortunalty no official o2 presence here only customers helping customers.
Try contacting htc again as it may be a europe wide warranty but as you have no proof of original sale you may not get very far.

You may get a response from the O2 by email. The addresses I have are as follows:

You should be able to call them on +44 8000 321 402, but that will be an international call for you.
It might be worth asking O2 Germany for the contact details they expect you to use for O2 UK.
I would still think your best bet is HTC, they should be able to determine whether the phone is still under warranty from the serial number if nothing else.

Surely warranties for products purchased within the EU are valid in all EU countries. This is an EU Directive which also extends the warranty to 2 years for new products.
Certainly companies such as Nokia and Nikon have EU-wide warranties which allows the consumer to obtain repair/replacement in any EU country no matter where the original purchase was made.

O2Mach - Yes you are right the warranty is enforceable in any EU country. For clarification the warranty statement is available here:

However they will try to insist on a proof of original purchase which is not available in this case and they state that the warranty is not transferable upon sale of the product other than with their written consent. That probably won't stand up under English or German law, but you are reverting to statutory rights.
