Anyone know a quick way to get out of an o2 contract, if I never have to deal with o2 again it will be to soon. They have let me down totally , I got a new phone that went faulty, I reported it to the shop they told me I needed to see a Guru for this pleasure I had to wait 6 days. He said the phone was faulty and would be sent back to the supplier and replaced, a few days later I got a repaired phone back, and was told it had been fixed by HTC I was not happy and even more so when it went faulty again, I contacted HTC and they have never seen the phone. o2 have admitted it never went back to HTC. Now I'm been told that because the phone was not taken back within 28 it was but I had to wait to see the guru lol. They think they are doing me a favour by offering a "refurbished" phone. I have been a customer of o2 for many years but this means nothing. Both me and my wife are sick of sending email's and sick of the lack of care o2 are taking. I have told them they can have the phone back as I'm not using it and just cancel my contract but o no they want me to have a second hand phone and pay my full monthly fee. But if I want out of the contract then they want a big cancellation fee, not a bad deal o2 you make me wait to see a Guru then blame me for not taking it back within the 28 days, then you lie to me about the repair and i still have to pay. thats what i call a rubbish service

hi 02mach02 i tried been nice calm and willing to listen to anything then after so long and so many emails and been lied to i went from calm to very cross, then after getting email after email off them saying reply to this email then getting another email saying you have to fill in details on line its just got to much. now i just want away and nothing to do with them at all but im not willing to pay a big fee to do this when i have done nothing wrong other than trysuting o2 sorry this is negative but i cant think of anything good to say about this whole sorry ordeal

ofcom will not act on your complaint until o2 have had their 8 weeks and then it is the ombudsman on that link not ofcom you go to

I have just embarked on this procedure and I must say I am very disappointed with the advice I have been given by o2, and apprehensive of the outcome having read various posts from other people with faulty handsets. I have been a customer since this network was Securicor Cellnet and loyalty appears to count for nothing. I am stuck with a faulty handset - HTC as well incidentally - I have to send it away 3 times apparently before I will be considered for an early upgrade / replacement. Not happy at all, since I rely on my phone not only for work, but to stay in touch with an elderly sick relative.... I feel the only solution is to see out my contract with "unfit for purpose" goods, buy another phone, or pay off my contract. The last two of these are expensive options which I can ill-afford but I'm afraid o2 that you need to consider your customers - it takes years to build a reputation and seconds to lose it. I will be going elsewhere......

Having looked into my rights as a consumer, it would appear that o2 are in breach of "statutory rights" as, although they offer to repair, they do not guarantee a "like for like" temporary replacement..... hmmm

I think it is the store who offer a temporary replacement while yours is away for repair, usually for a deposit of about £25, but not sure it will be a like for like phone.

Have you tried contacting HTC directly about the faulty phone?

Yes o2 helpline told me I would have to go to a store, pay a deposit and then take a "temporary replacement" phone whilst mine was investigated. As you rightly say, there is no guarantee of a like for like, I waould have to accept whatever they offered. This is in breach of my statutory rights - if my phone is sent for repair, I am entitled to a like for like replacement. According to other posts, if I approach HTC direct there will be a cost to me and besides, my contract is with o2. o2 provided me with the phone, not HTC. o2 are responsible for ensuring my phone is fit for purpose for the duration of my contract. At present they do not appear to be interested in fulfilling their obligation....
