Can anyone advise me, i have an iphone 4gs which is under contract until april next year and since my last update to ios 6.1.3 the wifi stopped working, i visited apple and for £150 they could give me a new phone to replace it but would do nothing else. I contacted 02 who tell me its not their problem because they only provide the tarriff. My phone has since stopped making calls or recieving calls. I now have an iphone 4gs, £45 per month contract and have no phone or wifi ability

Ah, okay. I understand now. Sounds like a lot of effort, which could possibly come to nothing. The OP has said they can claim on their insurance. That sounds like the best route to take. Either that or cough up the £150 for a phone from Apple.

spoke with 02 today and they said yes your presentation of facts indicates that it is not fit for purpose however we need our people to look at it so drop it to an 02 store and we will have it repaired, they also said that they will put everything in the notes so the store will know once they look up my account. Got to the store, charging me for repairs and cannot see what anyone puts on accounts!
i understand that it was out of warranty but i believe when paying 02 £45 a month for an apple iphone and tarriff (which is not adjustable with the 24 months) then the phone should do what it is supposed to, and that 02 should have responsiblity whilst im paying the iphone tarriff with them

im chattinjg with them now again, getting nowhere. asked for the number to contact them, he says dial 202 from your phone (which i have told them over and over again is in THEIR shop)
Anyone have a free number to ring from a landline?

As adamtemp suggested, try the saynoto0870 site. There are a bunch of 0800 numbers you can try. Type in O2 after you click on Search to find an alternative number.
