Can anyone advise me, i have an iphone 4gs which is under contract until april next year and since my last update to ios 6.1.3 the wifi stopped working, i visited apple and for £150 they could give me a new phone to replace it but would do nothing else. I contacted 02 who tell me its not their problem because they only provide the tarriff. My phone has since stopped making calls or recieving calls. I now have an iphone 4gs, £45 per month contract and have no phone or wifi ability

Now if this is a faulty componets taht apple may have known about then you could start to quote the sale of goods act to o2.
You will have to prove that this component is known to be faulty from manufacture.
This is only available via the retailer not the manufacturer

yes i have restored the settings but it didnt work, i went through all 02's problem solving and apples suggestions. I recently had it through a diagnosis test and apparently its the chip (dont know which chip) this chip is a common fault, the information is being sent but not being recieved by various components.

Without insurance I think you'll have to pay the out of warranty costs or buy a cheap phone to see you through to the end of your contract.
Also, you could look in "My O2" to see what your early upgrade to a "Refresh Contract" would cost (these are discounted).

Other than that you could sell the non working iPhone and use the funds to buy one from places like CEX.
With the new iPhones being launched I can see a lot of iPhones knocking about or perhaps a friend or colleague will upgrade and sell you theirs cheaper.

In most EU member states, consumers may only claim for defects that were present on delivery. There are some exceptions, including Czech Republic and Romania. The burden to prove that the defect (including latent defects) existed on delivery generally shifts to the consumer after the expiry of a period of 6 months from date of delivery.
