iphone 5s - 16months old - hardware fault - Apple refuse to replace

Appalling customer service. My iphone won't turn on. Apple have diagnosed 'hardware fault' - say it's out of warranty so the only solution is to buy a new phone. Phone was new last Feb. Not impressed at all

That's the risk you take buying Apple products without paying for extended warranty.
All Android phones come with 2 year warranty as standard.
If you can prove fault was present in phone from new, you can claim under sale of goods act, otherwise, you need to pay for repair I'm afraid.

February 2015? If so you have a 12 month warranty with Apple?

Edit: Apologies...when the OP said LAST February I presumed it was the one just gone Smiley Frustrated

You can get an out of warranty replacement from apple for around £150...refurbished but good as new.

The Sales Of Goods Act states all electrials should last a minimum of 6 years which hasn't happened. Go back to Apple and inform they they are in breach of this Act by not providing a free repair or replacement.

I doubt that would apply to a device with an expected life of only a couple of years, sold with a one year warrantee.

Normal wear and tear is also excluded as a possible claim.

And where a mobile phone is involved is it not the "Sales of Goods and Services Act" which is quite different?

For SOGA to apply to anything you have to prove there is an inherent design fault or that the problem existed at point of purchase.
