Bringing up an old thread a little. However, right are important.
If the OP can prove that he was given misleading over the phone clearly stating that 4g could be used on the iphone 5, and that means o2 having to bring up the recording and listening to it...
Then it would be classified by trading standards as failure to produce as agreed and OP would be entitled to his/her money back, never mind if it wasn't advertised as having 4g on the website.
The problem is a lot of sales people (not all) will do anything to get a sale and arent to bothered what lies they spin to achieve this.
Perhaps is was a genuine mistake on their part, even so the OP would still be entitled to their money back.
3g is fine anyway and 4g coverage isn't that great as yet so no biggie...

I've just found out that iphone 5 is not compatable with $g on o2 network. despite being told by o2 advisor that i had a good 4g reception in my area. and he was fully aware that we both had iphone 5. not a very happy bunny,

You can get 4G with iPhone 5 but unfortunately not on O2. After 2 years or more the product knowledge of the staff is quite alarming.
