Not be compatible with the networks 4G, as they had not had the the full Tech Specs from Apple till then...... And I challenge O2 to playback the recording of my last conversation with customer service before disputing this.

This promise was launched at the same time the iPhone 5 was released, this phone was never sold as being 4G compatible on the O2 network:

Many were disappointed when O2 chose a frequency that didn't let the iPhone 5 operate on its 4G service myself included.
Have Customer Services responded to your request for a transcript of the conversation.
You do have some alternative options such as the Refresh Tariff ,and if applicable the iPhone 5 promise from O2.
Or sell your iPhone 5 to raise funds to buy the iPhone 5s ,and then take up one of the available 4G tariffs.
I'm quite happy with my iPhone 5 purchased from Apple ,but as I'm interested in 4G I will be following my own advice and selling this to buy the iPhone 5s.

@bob why did o2 not chose 1800mhz? (because ofcom did not sell off 1800mhz and o2 do not have enough 1800mhz bandwith to convert it to 4g )

I didn't pose that question in my reply as I know the answer.
I purchased my iPhone 5 on release date which obviously was way before O2 confirmed what was happening with 4G.
I stated in my reply I was disappointed.

O2 had no choice ofcom dictated only ee could use 1800mhz and apple did not make it work on the 800/2600 bands so again not o2 fault
Facts not what the op wants to read and o2 on day of release said it would never work on o2 again a fact.

Mostly it's people who need assistance.
If a person has spoken to someone official at O2 ,and proceed with the order after listening to what's been told only to find out that the product will not perform as promised then their is cause for issue.

I don' think you will have any redress on your situation.
1. The iphone 5 was never advertised as being 4G compatible on the O2 network
2. The iphone 5 promise was issued for anyone wishing to upgrade to a 5S when 4G became available.
3.This promise was only available to iphone purchasers.

As said, if you want 4G either go down that route or sell your present phone and upgrade to a 5s or 5C.
