iPhone 5 19 months into contract and the camera has stopped working

I've had my iPhone 5 for c. 19 months and the camera has stopped working. It appears that this is quite a common hardware fault (https://discussions.apple.com/thread/5327076). I contacted Apple who recommended several things (full restore to factory settings, etc) but to no avail. Then it came to contacting O2 who said that as the phone was out of warranty they would charge me for the repair. Under SOGA 1979 I know that I'm entitled to raise an issue with the phone for up to six years and even Apple's website now states the mandatory 2 year coverage. Given that it's a 2 year contract it's fairly reasonable to expect the phone to last for 2 years. I even tried Apple again who agreed with me that the SOGA covered this instance but O2 fail to understand either SOGA or the fact that the legal responsibility lies with the Retailer and not the manufacturer. They keep quoting the "Apple 1 year warranty" like a company mantra as if this magically removes any responsibility from them.

I have now raised a complaint with their Complaints department regarding what I think is a known fault with the hardware but after having read many dispirited stories about O2's legendary customer service I was wondering whether anyone had had experience with Small Claims Court proceedings and how effective/quick they are.

I've made an appointment for tomorrow on the off chance that they can do something about it but I won't hold my breath as the online support person said that it was almost definitely a hardware issue. I'll let you know how it goes. Cheers

The way I look at it is your then covering all the bases in your complaint.

Put it this way it cannot harm.

I've also heard of apple stores actually replacing the phone even when out of warranty as a GWG.

Latest is that Apple have diagnosed a hardware issue and said that the phone cannot be repaired but required a full replacement. Cost is £209.

Any other phone would be covered by a 2 year warranty without any fuss at all.... It's a shame Apple refuse to warranty their highly expensive bits of tech for any longer than 1 year.....
I have no affiliation whatsoever with O2 or any subsidiary companies. Comments posted are entirely of my own opinion. This is not Customer Service so we are unable to help with account specific issues.

Doesn't really matter as SOGA covers for up to 6 years and given that O2 sold me a 2 year contract I think we can safely say that they expect the phone to last 2 years. Unfortunately SOGA means I have to deal with the Retailer and not the Manufacturer. Under EU law Apple are obliged to provide cover for 2 years: http://www.apple.com/uk/legal/statutory-warranty/

But even under the EU Law you still have to claim from the Seller

Did they give you paperwork from the diagnostic report.

I'm amazed you managed to book a genius appointment for the next day. Everywhere I looked its around a week. 😞

I'm looking forward to your updates if this goes all the way.

A first I will have seen personally if it does.

I insisted on a report confirming the diagnosis which I have scanned and sent to O2 to support my complaint. I work at Covent Garden and was lucky enough to get one for the next day slight_smile Guess it's a pretty big store
