But I had one fail a few month after getting my 4s rang apple and they just posted me one out no need to return the old one

The phone is an Iphone 5S purchased late October 2103 but, in any case, the question was a general one re. liability.
O2 customer service (in shop and online) deny any responsibilty and insist that I would have to send or take it to Apple, at my own expense. Which, to me, seems to fly in face of Sale of Goods act etc.

It may be worth noting that the apple 1 year warranty is in addition to the soga.
Apple will swap on the spot yet o2 would send it away for repair as it is allowed to under soga.
But as I said apple just sent me one out no questions asked.
We all recomend in year 1 you deal direct with apple as we here so many horror stories re the o2 repair company.
