It was made clear when the 5 was launched that it would not work on O2 4G, that's why O2 allowed the early upgrade promise.
There has been no mis-selling at all.

Hi.

Fully understand your frustration if that is what you were told.

Look at MI5's link.

You could however sell your iPhone 5 to raise funds to buy the iPhone 5s.

Apple give £220 trade in which is a little low.

Then take up a 4g tariff.

Or look at the speed to refresh option.

If you were specificially told you could use 4G with the phone, there could be potentially a grounds for misselling HOWEVER you would firstly have to take this up with where you bought the phone from and you would also have to prove that you were told this which could be tricky especially as it was fairly common knowledge at the time that the only network that the iPhone 5 supported was EE and possibly 3 when they launch

It was perfectly clear on this site that the iPhone 5 would not work on the 4G supplied by O2.
